Terms governing Methylation.us and its services

1

Acceptance and scope

These Terms apply to website visitors, purchasers, account holders, test participants, and anyone who acts for a participant. References to “Methylation.us,” “we,” “us,” and “our” mean the legal entity operating Methylation.us and, where appropriate, the laboratories, fulfillment companies, payment providers, and other contractors used to provide the selected service.

Product pages, collection instructions, consent forms, checkout disclosures, written order confirmations, and policies linked from these Terms form part of the agreement for the applicable product. Test-specific instructions control if they conflict with general educational content elsewhere on the website.

2

Eligibility, authority, and informed consent

You must be legally able to enter into a binding agreement to place an order. You must also have lawful authority to arrange testing for every participant included in an order.

  • Do not collect, submit, or arrange analysis of another person's sample without the informed consent or other lawful authorization required for that test.
  • Testing a minor or a person who lacks legal capacity may require authorization from a parent, guardian, or another person with lawful authority.
  • All required consent forms, labels, identity information, provider orders, or supporting documents must be accurate and complete.
  • We may decline, suspend, or cancel an order if consent, identity, authority, eligibility, or documentation cannot be confirmed.
3

Orders and product selection

You are responsible for reviewing the purpose, price, sample type, report scope, collection method, turnaround estimate, limitations, and intended use of a test before ordering.

An automated email or checkout confirmation means that the website received your order. It does not necessarily mean that the order has been finally accepted or that the product is appropriate or available for your circumstances.

  • We may request corrected information, additional documentation, or confirmation of eligibility before fulfillment.
  • Products, prices, laboratories, report formats, and availability may change.
  • We may refuse or cancel an order that appears unlawful, fraudulent, unsafe, incomplete, incorrectly priced, unavailable, or inconsistent with these Terms.
  • If we cannot fulfill a paid order, we will provide the remedy required by the applicable policy and law.
4

Prices, taxes, payment, and insurance

Prices are displayed in U.S. dollars unless stated otherwise. The total shown at checkout may include applicable taxes, kit delivery, courier service, optional services, or other disclosed charges.

  • You authorize the payment method submitted at checkout to be charged for the order and approved additional services.
  • Testing or report release may be delayed until required balances are paid.
  • Obvious pricing, product-description, or technical errors may be corrected before fulfillment. You will be contacted if a correction materially changes the order.
  • Insurance reimbursement, HSA/FSA eligibility, or payment by another party is not guaranteed.
  • You remain responsible for charges not paid or reimbursed by an insurer, employer, benefit account, or other third party.
5

Collection kits, fulfillment, and delivery

A kit may be prepared and shipped by Methylation.us or by a laboratory or fulfillment provider working on the order. Delivery methods, fees, and estimates are stated during checkout or in the applicable shipping information.

  • You must provide a complete and accurate delivery address, email address, and telephone number.
  • Tracking is provided only when available for the selected shipping method.
  • Delivery dates are estimates unless expressly guaranteed in writing.
  • Additional charges may apply when a package is returned because of an incorrect address, refused delivery, failure to collect, or another issue outside our control.
  • If shipment cannot occur within the promised period, available delay, cancellation, or refund options will be handled as required by applicable law.
6

Sample collection, labeling, storage, and return

You must follow the instructions supplied with the selected test. Sample requirements can differ between genetic, epigenetic, biological-age, nutrient-metabolism, and lifestyle products.

  • Use only the approved sample type, collection materials, labels, and packaging.
  • Complete required forms and ensure participant names and identifiers are accurate and consistent.
  • Use the return address supplied with the specific kit; do not use an address from another product or an older order.
  • Return postage is included only when the product or kit instructions expressly say that it is included.
  • Keep return tracking information until delivery is confirmed when a tracked service is used.
  • A sample is not considered received merely because it has been mailed.
7

Laboratory processing and turnaround estimates

Published turnaround periods are estimates and normally begin when the designated laboratory receives an acceptable sample and all required information. The order date, kit-delivery period, return transit, accessioning, document review, payment delay, recollection, and events outside laboratory control are not included unless expressly stated.

Processing may be delayed by sample quality, missing documentation, equipment or system issues, supply shortages, scientific review, quality-control procedures, severe weather, public-health events, carrier disruption, government action, or other circumstances beyond reasonable control.

We may move an order to another appropriately qualified laboratory or method when reasonably necessary, provided that the material scope of the purchased service is not reduced without notice and an appropriate remedy.

8

Reports, access, and responsible use

Reports may be delivered by email, downloadable PDF, secure portal, laboratory portal, or another method stated for the product. Certain services may require activation or account creation with a third-party laboratory platform.

  • You are responsible for protecting account credentials, report links, downloaded files, and printed copies.
  • You must promptly report suspected unauthorized access or delivery to the wrong recipient.
  • A laboratory may correct a verified clerical, formatting, interpretation, or technical error and issue an amended report.
  • Reports are supplied in the format and language stated for the selected product unless another arrangement is confirmed in writing.
  • You may share your report with healthcare professionals or other people you authorize, subject to law and third-party platform restrictions.
9

Scientific, medical, and testing limitations

No genetic, epigenetic, biological-age, metabolism, wellness, or laboratory test is infallible. A result depends on the sample, tested markers, laboratory method, reference population, quality controls, information supplied with the order, and scientific knowledge available when the report is prepared.

  • A report may be inconclusive, incomplete, unexpected, or require confirmation using another method.
  • A negative, typical, or low-risk result does not rule out every genetic variant, nutrient issue, medical condition, future health event, or non-genetic influence.
  • A predisposition or pathway result does not establish that a person currently has or will develop a condition.
  • A biological-age estimate is method-dependent and is not a definitive measurement of lifespan, health status, or future disease.
  • Recommendations in wellness reports are educational and may not be appropriate for every medical condition, allergy, medication, pregnancy, nutritional requirement, or treatment plan.
  • Unless expressly sold as a legally admissible service, a test is not intended for court, immigration, custody, inheritance, employment, insurance, or another formal legal purpose.

Do not use website content or a report as emergency guidance. Discuss material findings with an appropriately licensed healthcare professional before making significant medication, supplement, diet, or treatment changes.

10

Unsuccessful samples, recollection, and retesting

A sample may be unsuitable or unsuccessful because of insufficient material, contamination, incorrect collection, improper labeling, storage conditions, transit delays, biological factors, missing documents, or laboratory issues.

If a verified laboratory error caused the failure, the appropriate corrective action will be arranged without charging again for the repeated laboratory analysis. If the issue relates to collection, sample quality, labeling, packaging, storage, shipping, missing documentation, or another cause outside laboratory control, replacement-kit, shipping, recollection, or retesting charges may apply.

11

Order changes, cancellations, and refunds

Contact us promptly if you need to change or cancel an order. Eligibility for cancellation, replacement, credit, or refund may depend on whether payment has been processed, a kit has been prepared or shipped, third-party costs have been incurred, a kit has been activated, a sample has been received, or laboratory analysis has begun.

  • Do not mail a kit back without receiving return instructions.
  • Shipping, courier, processing, activation, collection, laboratory, or third-party fees already incurred may be non-refundable when permitted by law and clearly disclosed.
  • Approved refunds are returned through the original payment method unless another lawful arrangement is made.
  • Nothing in these Terms limits a cancellation, refund, warranty, or consumer right that cannot lawfully be waived.
12

Privacy, genetic information, and service providers

The Privacy Policy explains how personal information is collected, used, disclosed, retained, and protected. By ordering, you acknowledge that customer, participant, sample, and report information may need to be shared with laboratories, fulfillment companies, payment processors, technology providers, customer-support providers, healthcare professionals, or other parties involved in delivering the selected service.

Health-related information on a commercial website is not automatically protected by HIPAA. Whether HIPAA applies depends on the status and activities of the organizations involved. Review the Privacy Policy and any laboratory privacy notice before ordering when privacy protections are important to your decision.

Do not submit another person's sensitive information unless you have authority to do so. Do not send genetic reports, identification documents, or detailed medical information through an unsecured communication channel unless instructed to use that method.

13

Accounts, passwords, and electronic communications

You are responsible for maintaining the confidentiality of login credentials and for activity conducted through your account. Use accurate account information, a strong unique password, and available security features.

  • Notify us promptly if you suspect unauthorized account access.
  • Do not access another person's account or report without authorization.
  • You consent to receive order-related electronic communications at the contact information you provide.
  • Marketing communications are subject to the choices and opt-out methods described in the Privacy Policy.
14

Acceptable website and service use

You may use the website and services only for lawful purposes. You must not:

  • submit false identity, consent, billing, health, participant, or shipping information;
  • collect or submit a sample without required consent or lawful authority;
  • use a test or report to harass, discriminate against, impersonate, exploit, or unlawfully investigate another person;
  • interfere with the website, accounts, portals, security systems, laboratories, or service providers;
  • introduce malware, scrape restricted content, bypass technical controls, or conduct unauthorized security testing;
  • copy, resell, sublicense, or commercially exploit website content or reports beyond the rights expressly granted; or
  • use the service in violation of law or another person's rights.

We may restrict access, decline an order, preserve relevant records, or report suspected unlawful activity when reasonably necessary and legally permitted.

15

Website content and intellectual property

The website design, text, graphics, logos, downloads, educational material, and original content are owned by or licensed to the website operator and are protected by applicable intellectual-property laws.

You may use publicly available content for personal, non-commercial informational purposes. No ownership is transferred, and no permission is granted to reproduce, modify, distribute, sell, scrape, or create commercial derivative works unless written authorization is provided.

Laboratory names, trademarks, report templates, and third-party materials remain the property of their respective owners and may be subject to separate terms.

16

Third-party laboratories, platforms, and links

Some services may be performed or supported by independent laboratories, fulfillment providers, payment processors, portal operators, carriers, or healthcare professionals. Those parties may have separate terms, consent forms, privacy notices, and operational requirements.

Links to external websites are provided for convenience and do not mean that we control or guarantee their content, availability, security, or practices. Review third-party terms before using those services.

17

Disclaimers and no guarantee of outcome

We do not guarantee that a test will answer every question, produce a particular result, identify the cause of a symptom, qualify for reimbursement, be accepted by a healthcare professional or authority, or lead to a specific medical, legal, financial, lifestyle, or personal outcome.

To the fullest extent permitted by law, the website and services are provided subject to the descriptions, limitations, and warranties expressly stated for the applicable product. Nothing in these Terms excludes liability, warranties, or consumer protections that cannot lawfully be excluded.

18

Responsibility and limitation of liability

To the fullest extent permitted by applicable law, the website operator and its service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from website use, delayed delivery, unavailable services, unauthorized account access, reliance on educational content, or use of a report outside its stated purpose.

Any limitation must be interpreted together with applicable consumer law and does not apply where liability cannot lawfully be limited, including any rights arising from fraud, willful misconduct, or other non-waivable legal protections.

19

Changes to services and these Terms

We may update products, prices, laboratories, collection methods, reports, policies, or these Terms to reflect changes in services, law, science, technology, or business practices.

The revised Terms will be posted with a new “Last updated” date. Changes apply prospectively unless law or the notice accompanying the change requires otherwise. The terms accepted when an order was placed continue to govern that order to the extent required by law.

20

General provisions

If a provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision on one occasion is not a waiver of that provision.

You may not transfer your rights or obligations under these Terms without written permission. We may transfer the agreement as part of a merger, reorganization, sale, or transfer of the relevant business or assets, subject to applicable law and privacy obligations.

These Terms, the incorporated policies, product disclosures, consent forms, and written order confirmation form the agreement concerning the selected service. A final governing-law and venue clause must be approved and inserted by legal counsel before publication.

21

Questions, complaints, and legal notices

For customer-service questions, order concerns, or requests for clarification, use the Contact page or email info@methylation.us.

Include the order number, relevant dates, product name, and a clear description of the issue. Do not include a full genetic report, government identification, payment-card number, or detailed medical history unless you are instructed to use an approved secure method.

Before publication, insert the exact legal operator name, registered address, and address for formal legal notices in this section.
